Notwithstanding the foregoing, it is exclusively the user’s (your) obligation to maintain and control passwords to user’s (your) website(s), and user exclusively is responsible for all activities that occur in connection with user’s (your) user name, password, registered domain name(s), Simpleatom.com login information; as well as any and all scripts or programs added to the account by the user (you) or other authorized users.  Simpleatom will not be liable for any loss or damages of any kind, under any legal theory, caused by user’s (your) failure to comply with the foregoing security obligations or caused by any person to whom user(you) grants access to user’s(your) services.

10. Service Availability

Simpleatom cannot guarantee 100% availability of website hosting, domain registration, the Simpleatom.com website, coaching services, or any other tools or services offered by/through Simpleatom.  Simpleatom is not held liable for any kind of downtime/unavailability due to service maintenance or repair by hosting or domain provider(s), uncontrollable acts of God, power outages by any party, fires, acts of terrorism, or anything beyond Simpleatom/Service Provider’s control.   Customer agrees and understands that under no circumstances will Simpleatom be held liable for financial damages or any other damages.  Customer/user also understands that Simpleatom/Service Provider will not provide any kind of compensation due to any of the aforementioned events, or any other events as defined by standard practices in the industry.  Simpleatom will not be liable to user/customer or any other person in any event of any incidental, consequential, or punitive damages due to unavailabity/downtime, including loss of profits, loss of income, or cost of replacing said services.

11. Refund Policy/Cancellations

If for some reason you are dissatisfied with services offered through Simpleatom, you are welcome to cancel said services at any time and receive a prorated refund (amount to be determined by the Simpleatom billing department).  Refunds will not be given for 1 time services such as domain registration, website design, logo design, content creation (images, audio, video, text, software, etc), or assistance in creating or setting up an online store.  Refunds will only be offered in regards to Simpleatom coaching or webinar services.
